Arrest Made After Students Say Bay Path Teacher David Martinson Crossed The Line
On Monday, May 5, 2025, authorities arrested 61-year-old David Martinson on multiple serious charges.
Police charged Martinson with two counts of indecent assault and battery on a person 14 or older, three counts of criminal harassment, two counts of assault and battery, and two counts of accosting or annoying another person.
He pleaded not guilty during his arraignment in Dudley District Court the following day.
The charges stem from disturbing allegations made by female students at Bay Path.
According to court documents, students reported that Martinson inappropriately touched them and repeatedly made sexual comments.
The assault charges specifically relate to accusations that Martinson touched a minor student’s buttocks at school on two separate occasions, placed his hands around that student’s neck while asking if she liked being choked, touched a second student’s back and buttocks, and inappropriately touched a third student’s back.
Charlton police began investigating Martinson after two female students reported his behavior to teachers on March 11, with one student alleging he had grabbed her buttocks the previous day.
Police interviews revealed multiple students describing feeling “creeped out” by the teacher’s conduct.
Court documents detail numerous inappropriate comments allegedly made by Martinson, including sexual jokes, expressing desire to get a student’s phone number when they turned 18, commenting that a kneeling student was at the “perfect angle,” asking female students about engaging in threesomes, discussing his vasectomy, and repeatedly questioning a student about losing her virginity in front of classmates.
Bay Path Superintendent Kyle Brenner confirmed that Martinson was placed on paid administrative leave immediately after the allegations surfaced.
The school district has conducted an internal investigation while emphasizing its commitment to student safety.
In a communication to the school community, Brenner described the charges as “deeply concerning” and offered support resources for affected students.
Martinson’s attorney, Eric Goldman, defended his client by noting his 21-year teaching history without prior allegations or discipline, adding that Martinson “is well-liked and respected” as both teacher and coach.
The judge set Martinson’s bail at $5,000, which he posted the same day. He is scheduled to return to court for a pretrial hearing on June 16.
